This webinar is designed for you if you want to know the differences and requirements you need to meet under the Uniform Electronic Transactions Act and the Electronic Signatures in Global and National Commerce Act (E-SIGN). Learn why having your customer sign an authorization in your bank to receive disclosures electronically isn't all you need to do. There are common mistakes made and you need to avoid them to mitigate long term liability on a massive scale.

Do the alphabet soup regulations allow for electronic disclosures? Absolutely, even though the rules are not finalized. But you have to have followed the E-SIGN requirements first. Those requirements and the regulations will be reviewed so that you can save postage and make disclosures with bits and bytes instead of paper and postage.

Under website compliance we'll discuss:
  • Is weblinking good for your site;
  • What are the requirements and pitfalls of external links;
  • Frame use confusion;
  • Website management;
    • Retention
    • What should be on your pages
    • Advertising requirements, common violations and questionable practices
The basic requirements of CAN SPAM will be covered. While most banks are not sending commercial electronic mail messages, you need to recognize what they are and the requirements imposed by this law.

In closing we'll cover the risks of internet use by your employees. They are huge and need to be mitigated. We'll talk about risk management in the electronic environment. Using the internet can help employees work more efficiently. But controls must be in place. The revised Federal Rules of Civil Procedure were effective December 2006. Is this a retention requirement, or a location requirement? We'll spell it out for you.

Mr. Zavoina has been in finance and banking for 23 years. Over 20 years were with a holding company with two Central Texas community banks that had $534 million in assets, 89 branches spanning Texas and nearly 500 ATMs. After starting in loan workouts, Andy has been a consumer, commercial and real estate lender and managed those departments as well as being the banks first Webmaster. He was responsible for compliance, management, auditing, and training for both banks.

Andy is a past Chairman of the American Bankers Association's Compliance Executive Committee. He was the 2003 recipient of the American Bankers Association's Distinguished Service Award for his involvement and accomplishments in the field of regulatory compliance management. He was chairman of the Editorial Advisory Board for the ABA's Compliance Magazine, Compliance Action magazine, was a member of the ABA's Compliance School Board and is a BankersOnline Guru. He also served on the Texas Bankers Association's Compliance Committee.

He is a graduate of the ABA National Commercial Lending School, National Compliance and National Graduate Compliance School and is a Certified Regulatory Compliance Manager with the Institute of Certified Bankers. He has written numerous articles and lectured on compliance, the use of the Internet and technology as a tool, as well as compliance in cyberspace to local, state and national associations.
