One court case held that disclosures on a website were not effective because the hyperlink was colored, but not underlined, bolded, in caps or otherwise conspicuous. A video that played took away attention from the link, and there was a pre-checked box that was being agreed to. These are the unknown hazards we deal with today. Guidance isn't from regulators, but from courts and it could impact your bottom line. Do you "publish" compliance violations for the world to see? That can certainly happen if you have a website or use social media, and what bank today doesn't? If you weren't aware, "the world" includes your examiners at all state and federal levels, and your bank's work is always available for review and critique.

Yes, even the simplest of web pages can violate the law, and page counters can tell your regulator how many times a violation has been seen. Just because you saw it on a big bank's site doesn't mean it is OK for you to do. You must understand the risks and the rules. Multiple regulatory requirements influence what you can and should have on your web pages and other online advertising for loans, deposits, fair lending, privacy and regulatory guidance. The rules are not "in addition to," so much as they must be interpreted and applied to this medium. Some guidance items are unique, and we'll discuss them, too.

About the Speaker: Mr. Andy Zavoina, CRCM, is an Executive Vice President and Chief Relationship Officer with the Glia Group, Inc., best known for its interest in He joined Glia and BOL in 2003.

Mr. Zavoina has been in finance and banking for 37 years. Over 20 years were with a two-bank holding company which had $534 million in assets, 89 branches spanning Texas and nearly 500 ATMs. He managed loan workouts, has been a consumer, commercial and real estate lender, managing those departments, as well as being his banks first Webmaster. He was responsible for compliance -management, -auditing, and -training for both banks.

Andy is a frequent webinar presenter for BOL Learning Connect and a key contributor to conferences put on by BOL Conferences, Inc. In addition, Andy teaches live presentations at state association schools and regional compliance organizations across the U.S. and has served on the faculty of national banking schools. He has written articles and lectured on many facets of compliance, the use of the internet and technology as a tool, as well as compliance in cyberspace.

He also served on the Texas Bankers Association's Compliance Committee.
