  You have to understand how to apply and document the 8 factors that make up the Ability-to-Rules to ensure compliance with the new mortgage rules. Whether or not you make a Qualified Mortgage is up to you. But if you're making a covered transaction you have no choice about whether you consider the 8 factors and comply with the basic tenets of the ATR rules. If you make a QM, you're deemed to have complied with the Ability-to-Repay rules, but not all loans can be QMs. There's no reason to give up the loans that are not if you understand how to utilize the 8 factors of the Ability-to-Repay rules. (Plus, if you screw up on achieving QM status on a particular loan, you're fine, so long as you did what you needed to know under the basic ATR rules.) We'll emphasize the practical aspects of complying with the Ability-to-Repay rules by not only telling you what the regulation says, but how you actually do what you need to do.

We'll discuss the fine points of each of the 8 factors and give you suggestions for how to document your consideration of each factor. We'll discuss which elements are required to be verified and how you verify those elements. You'll learn what is acceptable to use for verification and what is not. You'll learn how to determine the monthly payment on simultaneous loans and you will understand what to count within the calculation of total monthly debt obligations and mortgage-related obligations. About the Speakers:
Mary Beth Guard currently serves as Executive Editor of BankersOnline.com, CEO of Glia Group, Inc. and Executive Editor of BankingQuestions.com. Since graduating from law school in 1980, Mary Beth has focused her work almost exclusively on the banking industry. Previously, Mary Beth served as EVP/General Counsel and COO for the Oklahoma Bankers Association, EVP of Specialized Services for Thomson Financial Publishing, and General Counsel for the Oklahoma State Banking Department. Mary Beth is on the advisory board for Bankers' Hotline. She has presented training programs for virtually every major national financial industry association, as well as more than a dozen state bankers associations and a host of other organizations. In addition, Mary Beth has written more than a thousand banking-related articles and is a BOL Guru.

Sonja Kriegsmann is new to the BankersOnline staff. She serves as the Executive Manager of BOL Insiders, LLC. Her more than 32 years of banking experience, with over 27 years as an attorney, includes both deposits and lending on the retail side of the bank and in administration developing policies and procedures, as compliance officer, and as in-house counsel. She has also worked as outside counsel to banks of a variety of sizes as well as other entities in the financial industry. She has worked for and with community, regional, and national banks.

While in private practice, Sonja worked extensively with the Indiana Bankers Association assisting banks of all sizes with compliance and operational issues. She has taught a variety of seminars and published a monthly compliance column in the Hoosier Banker magazine. Sonja has also been published in the ABA Bank Compliance magazine.
