Understanding the Alternatives in the Collateral Liquidation Process

INTRODUCTION
The collections process is complicated. Accordingly, understanding the various options that are available to a lender is important. By gaining an understanding of the implications of the liquidation process, a lender can be in the best position to understand the benefits and potential short comings of a short sale. Further, it is important for a lender to understand the correct procedure for the collateral liquidation process, both for real and personal property, to ensure that the lender may maintain a claim for a deficiency judgment against its borrower. About the Speaker: Adam LaBoda, Esq. is an attorney with Spencer Fane Britt & Browne LLP where he specializes in the representation of financial institutions. Jackwig, United States Bankruptcy Court for the Southern District of Iowa. He is a member of the Missouri Bar and the Kansas Bar Associations, as well as a member of the Kansas and Missouri Bankers Associations, and the Kansas City Bankruptcy Bar Association. He is licensed to practice law in Missouri and Kansas, as well as the federal district courts in Kansas and the Western District of Missouri.
