In walks your customer with a formal trust. He wants to transfer all his current accounts into the trust, for which he and his wife are trustees. The only little problem is that his daughter is a joint owner on all his current accounts. Your first thought: "I wish I had gone to lunch." But no such luck. Does he have to close accounts and reopen in the trust's name? Can the daughter take herself off the existing accounts and then you can update the signature cards? Advanced Deposit Issues will look at hard deposit questions like this one and it will offer some thoughts about how to handle many of the tricky issues on court-ordered accounts, POAs, Trusts and LLCs. This presentation is not designed for beginners in the New Account area.

What you will learn:
  • Can an agent or attorney-in-fact change ownership?
  • Can a formal trust have an attorney-in-fact as a signer?
  • Can two trusts be set up as owners of a joint account?
  • Can an LLC have an oral operating agreement?
  • Can an LLC have two or more managing members?
  • If an LLC is "disregarded," how do we open the account?
  • if there is an LLC that has three businesses as members what paperwork do we need?
  • Can an LLC be "DBA" another LLC?
  • Does a guardian have the right to name a POD beneficiary?
  • Can a guardianship account be set up as jointly owned with the guardian?
  • Can an executor name three authorized signers on an estate account?
These and many more questions will be addressed in our advanced session.
